A marital property regime in which both parties in a marriage are equal owners of any property acquired during a marriage. This holds especially true of any homes acquired during a marriage. Even if only one spouse is on the deed, the other spouse in a community property state is entitled to half the ownership interest in a property, barring anything in the prenuptial agreement that would supersede the community property law.
The other method of defying community is to have one of the spouses file a quitclaim deed and remove themselves from the deed.
